Terms of Service
These Terms of Service ("Terms") govern your access to and use of GageLog, a river monitoring and data aggregation service operated by Juniper Consultants LLC ("Juniper," "we," "us," or "our"). By creating an account or using the service you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age and have the authority to enter into a binding agreement on behalf of yourself or your organization to use GageLog. By accepting these Terms you represent that you meet these requirements.
2. Authorized Use
You may use GageLog solely for lawful purposes related to water resource monitoring, conservation planning, or environmental compliance. You agree not to:
- Share your account credentials with unauthorized parties.
- Attempt to access data sources beyond those permitted by your subscription plan.
- Reverse-engineer, scrape, or systematically extract data from the service outside of its provided API and export features.
- Use the service to transmit harmful, unlawful, or misleading content.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@juniperconsultants.com if you suspect unauthorized access to your account.
4. Subscription Plans and Payment
GageLog is offered on a subscription basis. Your chosen plan determines the number of gage data sources you may access. Subscription fees are billed in advance and are non-refundable except as required by applicable law. We use Stripe, Inc. to process payments; by subscribing you also agree to Stripe's terms of service.
We reserve the right to modify pricing with at least 30 days' notice. Continued use of the service after the notice period constitutes acceptance of the updated pricing.
5. Data Accuracy
GageLog aggregates data from third-party gage sources (USGS, Washington Ecology, and SCADA systems). We make reasonable efforts to ensure data accuracy but cannot guarantee that gage readings are free from error, delay, or interruption. Flow data should be independently verified before use in regulatory filings or binding water-rights decisions.
6. Text Message (SMS) Alerts
GageLog offers optional text message alerts for the gage monitors you create. By adding a mobile number as a delivery destination on a monitor, you consent to receive automated text messages from GageLog at that number for the alerts you configured. Consent to receive text messages is not a condition of purchase and is never required to use GageLog.
- You may only add a mobile number that belongs to you or that you are authorized to enroll, and you must notify us if you stop using that number.
- Message frequency varies and depends on how many monitors you create and on river conditions. Each monitor observes a cooldown period between alerts and is capped at 10 alerts per rolling 24 hours.
- Message and data rates may apply. Text alerts are supported on major U.S. carriers; carrier support may change without notice.
- Reply STOP to any message to cancel text alerts, or remove the text message destination from the monitor in your account. Reply HELP for help, or see our Privacy Policy for how we handle your number.
- Carriers are not liable for delayed or undelivered messages.
Text alerts are an informational convenience built on third-party gage data and third-party message delivery. They are not an emergency notification service and are subject to the data accuracy and service availability limits in Sections 5 and 7. Do not rely on them for life-safety, flood-warning, or evacuation decisions.
7. Service Availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, apply updates, or temporarily suspend access. We are not liable for losses arising from service downtime.
8. Intellectual Property
All software, designs, trademarks, and compiled reports produced by GageLog are the property of Juniper Consultants LLC. You are granted a limited, non-exclusive, non-transferable license to use the service during your active subscription. Raw gage data sourced from public agencies (USGS, WA Ecology) is in the public domain.
9. Limitation of Liability
To the maximum extent permitted by law, Juniper Consultants LLC and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the service, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Juniper Consultants LLC from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the service.
11. Termination
Either party may terminate the subscription at any time. Upon termination, your access to the service will cease at the end of the current billing period. We may immediately suspend or terminate your account for material breach of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, where Juniper Consultants LLC is registered, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in North Carolina.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice within the service. Continued use after the effective date of updated Terms constitutes acceptance.
